1. Thank you for using Foundation. Foundation is an aviation English language e-learning course provided by Latitude Aviation English Services Limited (We, Us, Our) and Registered in England and Wales (084063139) with the registered address of 129 North Hill, Plymouth, PL4 8JY, United Kingdom.


2. Our services include the supply to you of access to the Foundation aviation English language e-learning course and all associated support and processes (Our services) for an agreed time period (Course Duration). By using our Services, you are agreeing to these terms. Please read them carefully.


3. Our Services include both:
  3.1 The use of Foundation by corporate users who may purchase multiple copies of Foundation; and
  3.2 The use of Foundation by individual users who purchase a single copy for their personal use. 


4. Corporate users have the additional responsibility of ensuring that each of the individuals whom they enrol on the Foundation course also comply with these terms and conditions. This additional term becomes part of your agreement with Us if you use our Services.

Accessing Foundation over the Internet

5. Foundation is an e-learning course accessed via the Internet on personal computers, laptops, tablets and phones. Access to the Foundation course is through the English360 platform owned and operated by English360 Limited, a private limited company (with registration number 06879168) of the Quorum, Barnwell Rd., Cambridge CB5 8RE, United Kingdom (A partner of Cambridge University Press).

Please read the English360 platform terms and conditions carefully as they include conditions of access which also apply to your access to the Foundation course. The English360 platform system requirements are duplicated below.
Note the following system requirements. Please check that your systems support these minimum requirements:

  • Browser: Chrome 10+, Firefox 3.5+, Safari 4+, Internet Explorer 7+, Opera 10+
  • Operating system: Windows XP/2000/Vista/2003/7, OSX 10.3+
  • Screen resolution: 1024x768 or higher
  • Computer processor: Pentium 4 or newer processor that supports SSE2
  • Computer memory: 512 MB+
  • Internet connection: 1000 Kbps or faster

Firewall configuration

If internet access has been restricted by your administrators, please ensure these domains are added to the firewall to enable full access to content on the platform:

  • english360.com (this serves the html)
  • amazonaws.com (for user images and content)
  • cloudfront.net (for site image and styles)
8. Whilst English360 has made every attempt to make their platform accessible on all computing devices there are millions of different computing device configurations and We cannot guarantee that the Foundation interactive content will work perfectly on every device. In the unlikely event that you have a problem with the platform you can contact techsupport@english360.com


9. Generally speaking, if you can access email and send an attachment then you will have no problem with accessing and using the Foundation course. However, in using the Foundation course it is your responsibility to ensure that you have the minimum required internet connection (1000 Kbps or faster) and to be aware that interruptions in your internet provision will also interrupt your access to the course. We take no responsibility for course interruption due to your internet connection issues.


10. You will need an English360 account in order to use Foundation. You will either create your own English360 account or your English360 account may be assigned to you by an administrator, such as your employer or an educational institution. If you are using an English360 account assigned to you by an administrator, your administrator may be able to access or disable your account. To protect your account, keep your password confidential.

Time limits

11. On purchasing Foundation we supply you with access to the on-line course for a limited time (Course Duration). For individual users the standard Course Duration is four months. At the end of the Course Duration your access to the Foundation course and the English360 platform will cease. Your progress and completed pages and items will not be lost and should you require more time for completion you should contact the foundation administrator: foundation@latitude-aes.aero. Beyond the standard Course Duration We reserve the right to charge additional fees where extended Course Duration is requested by the user.


12. For corporate users the required Course Duration will be agreed with Us before course commencement. We reserve the right to charge additional fees where extended Course Durations are requested.

Copyright and intellectual property rights

13.  You may only use Foundation as an English language training course, and only as permitted by law, including any relevant laws and regulations applying to your country or territory.  We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.


14. Using Foundation © copyright Latitude Aviation English Services Limited 2016, all rights reserved, does not give you ownership of any intellectual property rights in our Services or the content you access.


15. Any unauthorised broadcasting, public performance, copying or re-recording will constitute an infringement of copyright.


16. Permission is granted for personal use only by subscription. Commercial copying, hiring and lending is prohibited.


17. It is expressly prohibited to modify, adapt, decompile or disassemble the content in any way or permit the content to be combined with or become incorporated in any other language training course.

Your use of Foundation

18. Foundation may only be used to teach English language competence. Foundation is not a substitute for any form of technical or skills based aviation training. In agreeing to these terms of service you agree not to rely on any of the aviation-related information in Foundation in a professional capacity in the aviation industry.


19. Our privacy policy (http://www.latitude-aes.aero/privacy-policy) explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that We can use such data in accordance with our privacy policies.

Use of statistical data

20. We shall be permitted to use statistical data arising out of use of Foundation and the English360 Platform by an individual, an institution or its authorised users. We undertake to use this data only for internal editorial purposes, academic research purposes and to monitor usage of Foundation. No personal data will be included in this statistical data and Our privacy policy will remain in force.


21. Owing to the nature of the Internet, we cannot guarantee that Foundation will always be available to users. You should ensure that You have appropriate protection against viruses and other security arrangements in place whilst using the Internet.


22. Foundation is an English language training course. It uses an aviation context to teach “Aviation English”, that is, the English language vocabulary and structure most useful for individuals working in aviation. Every reasonable effort has been made to ensure that the aviation related information contained in Foundation was accurate at the time of publication, however, we do not give any warranty that any such information will be accurate or complete at any particular time, or at all.


23. The Foundation course and all the information contained in it are made available strictly on the basis that you accept it on an 'as is' and 'as available' basis. Where you rely on any information or other material contained in it, you do so entirely at your own risk and you accept that all warranties, conditions and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings or otherwise in respect of this course are excluded to the fullest extent permitted by law.


24. We exclude all liability whatsoever, to the fullest extent permitted by law, in respect of any loss or damage resulting or arising from any non-availability of Foundation, or from reliance on the contents of Foundation or any material or content accessed through it.

Liability for our Services 

25. When permitted by law We will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.


26.  To the extent permitted by law, Our total liability and Our suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services.


27.  In all cases, We and Our suppliers and distributors will not be liable for any loss or damage that is not reasonably foreseeable.

Business uses of our Services

28. If you are using our Services on behalf of a business, that business accepts these terms. That business will hold harmless and indemnify Us and Our affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

About these Terms

29. We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We will post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.


30. These terms control the relationship between Us and you. They do not create any third party beneficiary rights.


31. If you do not comply with these terms, and we don’t take action right away, this does not mean that we are giving up any rights that we may have (such as taking action in the future).


32. If it turns out that a particular term is not enforceable, this will not affect any other terms.


33. The laws of the United Kingdom, will apply to any disputes arising out of or relating to these terms or the Services. All claims arising out of or relating to these terms or the Services will be litigated exclusively in the United Kingdom, and We and you consent to personal jurisdiction in those courts.
